  • Philadelphia Products Liability Lawyer Reports on Recalled Home Improvement and Construction Products

    By Arthur L. Bugay

The Consumer Product Safety Commission has recalled several home improvement and commercial construction products.

On December 6, 2012 the United States Consumer Products Safety Commission announced, in Release No. 13-059, a voluntary recall of the “Rigid Coil Roofing Nailers and Rigid Clipped Head Framing Nailers” imported to the United States by One World Technologies, Inc. and made by De Poan Pneumatic Corporation, based in Taiwan. [Note that nailers with a blue dot on the product packaging are not included in the recall].  These products are sold through Home Depot stores nationwide.  Pneumatic nailers are used to secure fasteners into roofs and woodwork.  “The orange and gray hand held drill shaped tools have the name (“Rigid”) on the side of the nailers in white type, black panel, model and serial numbers are located on the side of the nail tray/magazine where the fasteners are loaded.”

Investigation revealed that “the trigger assembly on the nailers can malfunction and involuntarily discharge a fastener, posing a laceration or injury hazard to consumers.”

The Consumer Product Safety Commission also announced, in Release 13-064, the voluntary recall of “a low” lead ball valve/shut off gas valves imported by Aqualine, Ay McDonald Manufacturing Company, FNW, Hodes, Legend, Leonard Valve and Mueller (Memphis, Tenn.) and manufactured by Fu San Machinery Company, Ltd. based in Taiwan.  The valves in question are “used in flammable gas piping systems used in commercial or residential settings.  They are brass shut-off valves assembled with pipe lines of ¾ inch and 1 inch ….”  The Consumer Product Safety Commission determined that “the valves can crack and cause gas leaks which pose fire and explosion hazards.”

The Consumer Product Safety Commission in Release No. 13-063, announced the voluntary recall of Wing Enterprises step ladder and step stool combination products, made by Suzhou Zhongchuang Aluminum Products Company, Ltd.  This product is imported to the United States by Wing Enterprises, Inc.  The product was recalled after Wing Enterprises received “nine reports of the ladder becoming unstable causing the user to fall and sustain injuries ranging from scrapes and contusions to a fractured collar bone.”  This is a Type 1A step ladder/step stool rated at 300 lbs.  The words “Switch-it by Little Giant” appear on the front of the top platform.  The ladder is an aluminum ladder that can be extended from a 2’ step stool to a 6’ step ladder.  These ladders are sold exclusively at Home Depot and were made in China.
