  • $2.2 Million Recovery for Machine Injury

    Case Summary:

    Our client, a production worker, had his right thumb amputated when a cut-off saw he was working with unexpectedly cycled after he accidentally stepped on the foot pedal while he was reaching to clear out debris build-up in the cutting area.

    Rick Jurewicz filed a lawsuit against the manufacturer of the cut-off saw machine. The manufacturer denied liability claiming that the injured worker’s employer had been offered dual palm buttons as the means of activation but declined this option.

    Rick claimed that safety should not be optional and that the dual palm buttons should have been the only way the saw should ever have been allowed to operate. He also claimed that the guard, which was supposed to protect the point of operation blade hazard, was inadequate as it did not prevent an operator from reaching into the machine.

     

    Outcome:

    Rick recovered $2.2 million dollars for our client. This recovery is now Rick’s 40 the recovery where he has obtained a verdict or settlement in excess of a million dollars.
