  • Galfand Berger Wins Critical Federal Court Case For Steelworkers

    Case Summary:

    Galfand Berger represented the USWA Local 88G in a dispute with Rohm and Haas over the payment of disability income benefits such as short-term and long-term disability. After Rohm and Haas refused to allow denials of disability income benefits to be appealed using the grievance and arbitration procedure set forth in the collective bargaining agreement, Galfand Berger represented the steelworkers in a case in the Eastern District of Pennsylvania, where the Court ruled the that company was bound to honor the collective bargaining agreement and allow workers to grieve these denials.

    Outcome:

    As a result of this decision, workers will now be able to grieve their disputes over disability income benefits, rather than have to file an expensive Federal lawsuit every time the company decides not to pay their benefits.
