  • Parent Companies Can’t Have Their Cake and Eat it Too: Undertakings at Subsidiaries’ Facilities Expose Parent Companies to Liability for Workers’ Injuries

Galfand Berger partner Brad Smith wrote an academic article published in the Pennsylvania Bar Association Quarterly. The article, titled Parent Companies Can’t Have Their Cake and Eat it Too: Undertakings at Subsidiaries’ Facilities Expose Parent Companies to Liability for Workers’ Injuries, focuses on a type of legal claim available to some injured workers that many attorneys are unaware of.

Some companies, known as subsidiaries, are part of a larger family of corporations that includes a parent company. Usually, an injured worker can only receive workers’ compensation benefits from their employer and cannot file a lawsuit against their employer. But if the injured worker’s employer is a subsidiary of another company, the injured worker may be able to sue the parent company. This means that the injured worker may be entitled to more compensation than just workers’ compensation benefits.

Galfand Berger attorneys are experienced at handling such claims. Brad and other Galfand Berger attorneys have recently sued parent companies of injured workers’ employers and obtained recoveries of $1.5 million, $2.5 million, $4.5 million, and $5 million.

Brad has represented workers and consumers injured by a wide variety of defective products, including conveyors, aerial lifts, cranes, poorly guarded industrial machines, coffee pots, shrink-wrapping machines, and printing equipment. In addition to victims of defective products, Brad has successfully represented clients injured in construction accidents, automobile accidents, and trip and fall incidents.

Since 2015, Brad has worked with other Galfand Berger attorneys to recover more than $44 million for his clients. His success has led to Brad’s membership in the Million Dollar Advocates Forum and the Multi-Million Dollar Advocates Forum.   Brad has also been recognized as a Rising Star by Super Lawyer Magazine every year since 2018. Only 2.5% of all attorneys practicing in Pennsylvania receive this honor.
