$160,000 Pre-trial Settlement for Fractured Wrist caused by Defective / Misassembled Bicycle
Case Summary:
Our client, a young man, had purchased a new bicycle from a major retailer. As he was riding the bicycle for the first time, the front wheel suddenly detached from the front fork, causing him to fall and suffer a fractured left radius.
We filed a lawsuit against the distributor and seller, as well as the company that assembled the bicycle, alleging the bicycle was defectively designed, improperly assembled, and sold in an unsafe condition contrary to the seller’s representations that the bicycle was fully assembled and safe to use.
Outcome:
Our client was taken to the emergency room immediately after the accident. He underwent surgery involving open reduction with internal fixation and made a successful recovery from his injuries with minimal follow-up.
Brooke Elmi, a partner at Galfand Berger, negotiated a pre-trial settlement of $160,000.00 for our client.
