  • $10 Million Recovery for Construction Site Fall

    Case Summary:

    Galfand Berger’s client, a 40-year-old construction framer, fell from the second floor of a house under construction and suffered multiple skull fractures and a severe traumatic brain injury. His doctors believed he would never fully recover and, sadly, he passed away four months after the parties reached a settlement, leaving behind two teenage children.

    Galfand Berger partners Debra Jensen and Bradley Smith sued multiple parties alleging that defendants failed to provide proper fall protection, violated their own policies and procedures, and violated OSHA guardrail mandates.  Using the parties’ own documents and admissions, Debra and Bradley argued that their client’s catastrophic injuries were preventable, and the fall should never have occurred.  Tragically, their client suffered for more than three years before his death during which time he could not speak, feed himself, or even move on his own volition, nor could he be a father to his children.

    The defendants challenged every aspect of Galfand Berger’s case – even questioning whether Debra and Bradley’s client had even fallen – but ultimately agreed to pay an 8-figure settlement to resolve the lawsuit.

     

    Outcome:

    Debra and Bradley recovered $10 million for our client. This settlement ensured their client received excellent medical care until his untimely death and will also provide for his two children well into the future.
