Case Summary:
Galfand Berger Senior Partner Michael Malvey has reached a $1.25 million dollar settlement on behalf of a client who was injured when her car was struck by a tractor-trailer on Interstate 78 in Berks County, Pennsylvania. Our client was on her way to work when her vehicle became disabled, causing her to pull towards the shoulder of the roadway. As she was about to exit her vehicle to try to determine what was wrong with her car, her vehicle was struck from behind by a tractor-trailer believed to be traveling approximately 55 mph. As a result of the impact, our client was ejected from her vehicle and suffered numerous injuries, particularly damage to her shoulder that left her with permanent limitations in the use of her arm.
Outcome:
The trucking company initially denied responsibility for the accident, blaming our client for not pulling her disabled vehicle completely out of the lane of travel. To try to discourage our client from filing a lawsuit, they initially offered her $25,000.00. We rejected the offer and filed a lawsuit against the trucking company for causing the accident and our client’s injuries. After three years of litigation, the trucking company ultimately agreed to a $1.25 million dollar settlement.
