$490,000 Recovery for Leg Fracture
Case Synopsis:
Our client was a carpenter working at a construction site. He was working near a concrete pour, when a hose from a concrete pump truck whipped around and struck him in the leg.
Our client suffered a debilitating injury to his right leg and had to undergo multiple surgeries.
Peter Patton, a senior partner at Galfand Berger, conducted a thorough investigation of this matter. Peter concluded that one of the Defendants -- the concrete pumping company -- operated the pump truck in an unsafe manner and in direct violation of their own safety manual! This manual clearly instructed that all people should be moved from the area around the hose while in operation. The concrete pumping company did not do so. Peter also concluded that another Defendant -- the construction management company -- failed to properly identify or evaluate the foreseeable hazards that would arise from operating the pump. In short, Peter, through his comprehensive investigation, established that our client's injuries were a direct result of both Defendants' misconduct.
Of course, Defendants attempted to deny all liability. They claimed the injury was the fault of our client and his employer.
Outcome:
As a result of his skillful advocacy, Peter resolved this matter before trial for $490,000.
