Power Tools
Manufacturers and suppliers of power tools have a legal and moral duty only to sell safe products. Many power tools contain a risk of injury due to unguarded moving parts. The moving parts of a power tool should have guarding to prevent serious injury. Injuries caused by portable power tools are burns, cuts, and strains. Sources of injury include electric shocks, particles in the eyes, fires, falls, explosions of vapors and gases, and falling tools.
Certainly the manufacturers and suppliers of power tools are not legally responsible for all the sources of injury mentioned above. However, if the power tool is unsafe due to a manufacturing defect or design defect and the power tool injures someone, that person has a claim against the manufacturer, supplier, and the distributor of a power tool.
Many seriously injured people do not consult lawyers because they do not think they can sue. Sometimes they think it is their fault or the fault of another worker that caused the injury. Nevertheless, just because you are accused of committing some unsafe act does not mean that you do not have a case. The injury was probably predictable.
Designers of power tools should consider foreseeable uses and misuses of industrial power tools to eliminate injury due to predictable human error. The failure of the power tool designers to protect against human error is poor design and makes them responsible for the injury.
Just because a co-worker contributes to the accident also does not mean you do not have a case. Negligence on your part, a co-worker's part or the company's part does not prevent you from filing a claim against the manufacturer, distributor, or supplier of the unsafe power tool. The key question is whether the power tool should have been designed to eliminate or reduce the condition that caused your injury.
